The ‘Space Commerce Certification’ Concept
Greenberg Traurig recently issued an alert regarding a new proposal from the Department of Commerce to establish a "Space Commerce Certification" process for novel space activities. This voluntary, "light-touch" framework aims to streamline mission authorizations for emerging sectors like in-space manufacturing and lunar operations by providing a centralized interagency review. While the certification is designed to reduce regulatory duplication, it does not replace existing FAA, FCC, or NOAA licensing obligations. Instead, it serves as a tool for operators to demonstrate compliance to these agencies, with the Secretary of Commerce generally expected to issue decisions within a 120-day window.
